We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
Q-Automatik is a car arbitrage platform that aggregates vehicle listings from third-party marketplaces including Facebook Marketplace, OfferUp, and Craigslist. The Service provides:

Q-Automatik offers the following subscription tiers:
Billing: Subscriptions are billed monthly or annually in advance. Payment is processed through Stripe. You authorize us to charge your payment method on each billing cycle.
Cancellation: You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.
Price Changes: We reserve the right to modify subscription pricing with 30 days advance notice. Existing subscribers will be grandfathered at their current rate for 12 months.

Third-Party Content: Vehicle listings, images, and descriptions are sourced from third-party platforms and remain the property of their respective owners. We provide links to original listings and do not claim ownership of this content.
License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
AS-IS SERVICE: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
NO GUARANTEE OF ACCURACY: We do not verify, guarantee, or warrant the accuracy, completeness, or reliability of any listing information, deal scores, or market analysis. All data is aggregated from third-party sources and may contain errors, omissions, or outdated information.
NOT FINANCIAL ADVICE: The Service provides informational content only and does not constitute financial, investment, or professional advice. Any decisions you make based on the Service are at your own risk.
LIMITATION OF LIABILITY: To the maximum extent permitted by law, Q-Automatik and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from:
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to Q-Automatik in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Q-Automatik and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
The Service contains links to third-party websites and marketplaces (Facebook Marketplace, OfferUp, Craigslist). We are not responsible for the content, policies, or practices of these third-party sites. Your interactions with third-party sellers and platforms are solely between you and those parties.
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, for any reason including:
Upon termination, your right to access the Service immediately ceases. We may delete your account data in accordance with our Privacy Policy. Sections 7, 8, 9, and 13 of these Terms survive termination.
Informal Resolution: Before filing a claim, you agree to contact us at legal@q-automatik.com to attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration: If we cannot resolve the dispute informally, any claims arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in Philadelphia, Pennsylvania, or remotely by videoconference.
Class Action Waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class or representative action. Class arbitrations, class actions, and representative actions are not permitted.
Exceptions: Either party may bring a claim in small claims court if it qualifies. Additionally, either party may seek injunctive relief in court to protect intellectual property rights.
Governing Law: These Terms are governed by the laws of the State of Pennsylvania, without regard to conflict of law principles.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Q-Automatik regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
